Child Support DNA Testing

Your rights as a father are important because the court believes that if you ever start paying child support and later learn that you

are not the father then you will still be held responsible for the child support owed up until DNA testing is done. If you happen to be married and your wife cheats, becomes pregnant and has a baby with this other man you still will be held responsible for child support should you split up and get divorced.

We believe this law is ludacris and should be changed immediately. Just because you are married to someone the court should never make you responsible for someone elses child. No matter how long you have raised the children as your own before finding out differently through DNA testing.

One case that comes to mind and was in the news recently is that of Frank Hatley in Georgia. Mr. Hatley was jailed for a year over back support even though the state new he was not the father. DNA testing confirmed he was not the father 13 years after the baby was born.

At this time they did stop any future support order, but still held him accountable for $16,000 in public assistance that was given to the mother during this time, and when he still thought he was the father.

After spending a year in jail, he has since been released from prison after a judge ruled him indigent, and should not be held for not making child support payments. They are still deciding if he should have to make any more back support payments on a child that is not his.

How many more men are sitting in jail right now with this same problem, who learned they were not the father through DNA testing? It is very disturbing to us that a state would put someone in jail who is living on the streets, or in their car. This person did not commit a violent crime or offence, and the child was never even his. Why are they not going after the mother or the real father of the child to pay for this public assistance? But instead the state still saw fit to spend more taxpayer money to house and feed a man who owed back support, just to make a point.

The only point we take from all of this is what was once meant to be used for helping raise kids, child support is now used by the states and federal government to save, and make themselves more money.

We believe that it is everyones right and duty to take care of their own kids, but not someone elses. More people should take a stand to have these laws changed and ammended to reflect what is fair and just for everyone involved, and advocate for DNA testing of every child with the father before child support.
